1. These terms and conditions apply to http://swarbrick.com (swarbrick.com) and to http://guy.swarbrick.com which are owned and operated by Guy Swarbrick
2. All images on the websites are copyright Guy Swarbrick/Swarbrick.com unless specified otherwise. Copyright is never re-assigned to third parties
3. Guy Swarbrick will grant account holders/clients a non-exclusive licence to reproduce these images in an editorial context in exchange for payment of an agreed fee in line with our payment terms
4. Editorial account holders /clients may publish images in print and/or online in order to provide a news story to the publication’s readership
5. Editorial account holders /clients must only use these images for editorial use and they must not be used for advertisements, promotional campaigns or competitions and neither re-sold, re-licenced or reproduced without prior written agreement with Guy Swarbrick
6. Guy Swarbrick grants commercial account holders/clients with a non-exclusive licence to reproduce these images in a commercial, advertising or promotional context in exchange for payment of an agreed fee in line with our payment terms. Any images supplied under these terms must not be re-sold, re-licenced or reproduced without prior written agreement with Guy Swarbrick
7. All other customers/clients are granted a license for personal use only. Images purchased under this license my be used for social media ‘profile’ pictures, personal (non-commercial) websites and similar uses. They must not be used for advertisements, promotional campaigns or competitions and neither re-sold, re-licenced or reproduced without prior written agreement with Guy Swarbrick. If you’re not sure, ask.
8. The images must not be published larger than 600 pixels on the longest length on websites, unless agreed in writing prior to publication. Reasonable steps should be taken to disable copying of images on websites by third parties. Full credit must be given to the copyright holder unless agreed in writing with Guy Swarbrick. Credit for images within publications must be given on the same page/spread. Credit for cover images may be given on a ‘masthead’ page.
9. The account holder/client must not alter the images in any way except for standard industry practices for cropping, colour balancing, cut-outs and contrast. These editing procedures must not alter the primary content nor alter the intended story shown
10. The images must not be used in a defamatory or libellous way and the account holder/client agrees to indemnify Guy Swarbrick in respect of any claims arising from such use
11. Guy Swarbrick will make every effort to guarantee accuracy on photo captions however the account holder/client is responsible for checking the data is correct. Guy Swarbrick does not accept responsibility for losses arising from possible inaccuracies.
12. There are no rights free images on the swarbrick.com website and all uses of images must be paid for at the agreed rates. Account holders/clients agree to provide Guy Swarbrick with copies of the relevant sections of the publication within thirty days of use. Each single use of an image must be paid for individually, whether printed or new media unless agreed in writing with Guy Swarbrick
13. Account holders/clients must make payments via self-billing or by requesting an invoice
14. All payments must be made by 14 days of use or ’14 days end of month following’ for credit account customers.
15. You must not disclose your username and password to any third party.
16. Images may not be copied, sent or otherwise supplied to any third party. Onwards distribution of any images obtained via the swarbrick.com website is prohibited for any purpose.

On our side

1. Account holder/client information obtained by Guy Swarbrick will not be passed to any third party
2. Guy Swarbrick will confirm that account holders/clients have read and accepted these terms and conditions before an account is issued
3. Guy Swarbrick has the right to terminate an account if the account holder/client is found to be in breach of these terms and conditions
